如何撰写出符合欧盟及亚马逊要求的DoC符合性声明文件？ 附赠欧盟DoC模板 ！-ESG跨境

相信不少出口商品到欧盟的亚马逊卖家收到亚马逊的邮件，通知卖家要提供商品的‌‌符合性声明（Declaration of Conformity，下列简称“DoC”）。

这段时间与许多卖家进行交流，发现卖家们对于DoC符合性声明文件存在许多不清楚的地方。作为一个卖家，应该如何安全稳当的将商品销售到欧盟市场？

首先我们先来普及一下基础内容：

DoC符合性声明文件是什么意思？

An EU declaration of conformity (DoC) is a mandatory document that you as a manufacturer or your authorised representative need to sign to declare that your products comply with the EU requirements. By signing the DoC you take full responsibility for your product's compliance with the applicable EU law.

根据欧盟规定DoC是一个强制性的文件。作为一个制造商或授权代表，需签署声明的您的产品符合欧盟要求。通过签署DoC文件，表明对产品符合适用的欧盟法律，并负有全部责任。

合格的DoC文件需要具备那些条件呢?

As a manufacturer, it is your responsibility to draw up the EU declaration of conformity (DoC). It should contain the following information.

作为制造商，您有责任草拟欧盟合格声明（DoC）。它应包含以下信息：

1）your name and full business address or that of your authorised representative.

（您的姓名和完整的公司地址或授权代表的名字）

2）the product's serial number, model or type identification.

（产品的序列号，型号或类型标识）

3）a statement, stating you take full responsibility.

声明，说明您承担全部责任（声明您承担全部责任）

4）means of identification of product allowing traceability – this can include an image.

可以追溯的产品识别手段-可以包括一张图片（允许返回的产品标识方法-可包括图片）

5）the details of the notified body which carried out the conformity assessment procedure (if applicable) .

进行合格评定程序的指定机构的详细信息（如适用）

6）the relevant legislation with which the product complies, as well as any harmonised standards or other means used to prove compliance.

（产品遵守的相关法律以及用于证明符合性的任何统一标准或其他方式）

7）your name and signature.

（您的姓名和签名）

8）the date the declaration was issued.

（声明签发日期）

9）supplementary information (if applicable).

（补充信息（如果适用））

10）For imported products, the importer must ensure that the product is accompanied by the DoC and must keep a copy of it for 10 years after the product has been placed on the market.

（对于进口产品，进口商必须确保该产品随附DoC，并且必须在产品投放市场后将其副本保存10年。）

11）You must translate the EU declaration of conformity into the language or languages required by the EU country in which your product is sold.

（对于进口产品，进口商必须确保该产品随附DoC，并且必须在产品投放市场后将其副本保存10年。您必须将欧盟符合性声明翻译成产品销售所在国家/地区所要求的一种或多种语言。）

根据欧盟的条款，目前是制造商具有起草欧盟符合性声明文件的权益，这边所谓的制造商，可以泛指为产品的生产商或是品牌方，也就是产品或是品牌的拥有者，方可起草欧盟符合性声明文件。

欧盟条款条款如下：

Manufacturers play a crucial role in ensuring that products placed on the extended single market of the European Economic Area (EEA) are safe. They are responsible for checking that their products meet EU safety, health, and environmental protection requirements. It is the manufacturer’s responsibility to carry out the conformity assessment, set up the technical file, issue the EU declaration of conformity, and affix the CE marking to a product. Only then can this product be traded on the EEA market.

制造商在确保投放到欧洲经济区（EEA）扩展单一市场上的产品的安全性方面起着至关重要的作用。他们负责检查其产品是否符合欧盟的安全，健康和环保要求。制造商有责任进行合格评定，建立技术文件，发布欧盟合格声明并在产品上粘贴CE标志。只有这样，该产品才能在EEA市场上交易。

If you are a manufacturer, you have to follow these 6 steps to affix a CE marking to your product:

如果您是制造商，则必须按照以下6个步骤在产品上粘贴CE标志：

1）Identify the applicable directive(s) andharmonised standards.

（确定适用的指令和协调的标准）

2）Verify product specific requirements.

（验证产品特定要求）

3）Identify whether an independentconformity assessment(by a notified body) is necessary.

(确定是否需要（由指定机构进行的）独立合格评定)

4）Test the product and check its conformity.

（测试产品并检查其合格性）

5）Draw up and keep available the required technical documentation.

（草拟并保留所需的技术文档）

6）Affix theCE markingand draw up theEU Declaration of Conformity(27 KB).

（贴上CE标记并起草EU合格声明）

These 6 steps may differ by product as the conformity assessment procedure varies. Manufacturers must not affix CE marking to products that don’t fall under the scope of one of the directives providing for its affixing.

（随着合格评定程序的变化，这6个步骤可能因产品而异。制造商不得将CE标记粘贴到不属于其粘贴说明之一的产品范围内。）

DoC文件应该由谁来签署负责 ?

根据欧盟产品合规法规显示，＂制造商＂是具有起草DoC符合性声明权利的人，而所谓的“制造商”泛指为产品的生产商或是品牌方。

欧代需要在DoC文件上签字吗？

根据欧盟的相关政策指导文件表示，欧代不需要在DoC符合性声明文件签字。

DoC符合性声明文件的意义，在于表达产品的生产商或是品牌方，对自己的产品符合欧盟合规条款是负全责的，属于自我声明的文件。即便欧代对于制造商交付的产品需要付连带责任，但毕竟他不是产品或是品牌的拥有者。

在欧盟委员会发布的DoC模板中有提及：

This declaration of conformity is issued under the sole responsibility of the manufacturer.

（此符合性声明由制造商全权负责。）

综合上述，DoC符合性声明表面上是一个非常简单好处理的声明文件。但是其在欧盟国家的意义，跟CE认证一样重要，决定着该商品是否能够在市场上销售。在欧盟产品合规法案正式落地之前，亚马逊平台也在持续打击不合规的CE标志产品，因此，卖家还是需要重视起来。
